This collection of papers belonged to H. M. Yerington, who was a shareholder in Cons Esmeralda and was very upset over the way the company was doing business. Yerington, in conjunction with other ;American stockholders, hired a British attorney to attempt a suit against the Board of Directors. The attorney was successful, but the opinion of the Judge was that the directors had acted within the power of the Articles of Incorporation, and that essentially, stockholders that did not provide an address in the United Kingdom had no right to receive documentation, nor participate in meetings. This Opinion is included in the lot. The attorney had secured the documents that Yerington had not received, including the prospectus and the announcement of sale of some mines to the Humboldt Electric Power & Mining Co. Datelined Denver, Colorado. ;Properties in Esmeralda County, Nevada. printed below title. A direct quote from the 1908 Copper Handbook, p.1065, is the only way to do justice to this piece. ;Alleged property was claims in the Grapevine district of Nevada, and O’Hara, the promoter, is a professional bunco-steerer, masquerading as a mine promoter. He was arrested, tried and found guilty of swindling operations in connection with the promotion of this company, and for punishment was given a light fine and a sentence of one day in jail, which leads to the inevitable conclusion that there is a very strong sentiment in Denver in favor of fake mining promoters. Denver is one o the most beautiful towns in the United States, but its population includes some of the greatest scoundrels in existence, and it has an un-enviable reputation among investors as the hatching place of a multitude of fraudulent mining companies. So notorious is this fact that legitimate mining companies with offices in Denver are seriously handicapped. No more needs to be added to a report like that. Extremely fine. Est. $100-200

555. Nevada. Lander. Austin. Austin Nevada Area Candlestick. Fine construction by a blacksmith in Austin, Nevada. This stick appeared to me originally to be a manufactured stick that was unlisted. After a detailed conversation with friend and author Ted Bobrink (Miners Candlesticks, by Wilson & Bobrink, 1984), we are calling it blacksmith made because it has detailed, fine, symmetrical fancy file work done to the candle holder and thimble. The piece was clearly made from one piece of steel, and several may have been made or manufactured by a blacksmith in Austin. This came from one of the old families there. Ted pointed out that the term ;blacksmith made refers to sticks made one at a time, instead of mass produced. He cited numerous examples of sticks that have numerous specimens known, but that they were made one at a time. He classed this stick in the ;semi-fancy class, not being fancy enough to compare with the figural pieces, etc. There is a distinct possibility that the stick was made by Parker Tin & Hardware, Austin, c 1895-1910. Parker made underground teapot lamps, and certainly may have made candle holders as well. We sold a lamp of his about ten years ago that had a plaque with his name. The piece was found underground at Nightingale, Nevada, and some of you might remember it from 20 years ago when I displayed it at Tucson several times.-fh Rare. Est. $200-400

696. Nevada. Storey. Virginia. ;A Peep At Washoe an article in Harper's Monthly Magazine, 1860-1861. By J. Ross Browne. The narrative written by Browne appears in three different issues, found in this compilation book on pages 1, 145 & 289 for the years of 1860 and 1861. Browne begins on page one with ;When I inform the reader that I have scarcely dipped pen in ink for six years, save to unravel the mysteries of a Treasury voucher; that I have lived chiefly among Indians, disbursing agents and officers of the customs; that I now sit writing in the attic of a German villa more than eight thousand miles from the scene of my adventures, without note or memorandum of any kind to refresh my memory, you will be prepared to make reasonable allowance for such a loose, rambling, and disjointed narrative as n Ex Inspector General can be expected to write under such adverse circumstances Browne goes on to discuss his experience in the west beginning in the mid 1950's, talking of the Kern River rush and the Fraser River rush leading up to the cry of ;Hurray for Washoe in the streets of San Francisco. Another paragraph sets the tone for the pages to follow, ;Kind and sympathizing reader, imagine a man who for six years had faithfully served his government and his country; who had never, if he knew himself intimately, embezzled a dollar of the public funds; who had resisted the seductive influences of Gold Bluff, Kern, and Fraser River from the purest motives of patriotism; who scorned to abandon his post in search of filthy lucre - image such a personage cut short in his official career, and suddenly bereft of his per diem by a formal and sarcastic note of three lines from head-quarters; then fancy you hear him jingle the last of his Federal emoluments in his pocket, and sigh at the ingratitude of republics. Would you not consider him open to any proposition short of murder or highway robbery? Then consider his position, as he stands musing upon the mutability of human affairs, when those strange and inspiring cries of Washoe fall upon his ears for the first time Each page has an illustration, but the artist is not noted. The last paragraph of the third article, Browne discusses negotiations he has with the Rothchilds to sell property in the land of Washoe to them, hopefully making millions. A wonderful series of articles written by one America's great geologists. The compilation has original hard boards with gilt lettering. Very fine. Est. $100-150

Moran, surveyor from Virginia City. c. 1910. Size: 28x41. Smaller map, ;Sheet No.2, shows North Bonanza shaft and all associated underground workings of company's property. c 1910. 18x 24. I had the pleasure of working on this property about 1991-92. After spending a serious amount of time on the geology, it appeared there was a classic low-grade gold deposit here. After viewing the high-grade gold specimens from the Adriatic in this sale, mined by Mr. Spargo, it appears we may have found a faulted extension missed by the old timers. Dawes, 24 x 34, set in glass fronted frame. Frame measures 30 x 35, matte 27 x 32. Matte does partially obscure the edges, covering some of the borders. An apparent tear or crease is barely noticeable crossing from the left to right about middle of the lithograph. This tear/crease is only visible upon close inspection, but when hanging on the wall it is unnoticeable. We have had only one of these fabulous Comstock Lithographs about 4 years ago. 721. Nevada. Storey. Virginia. Grosh Cons Gold & Silver Mining Co. Signed by S. C. Hastings as president. This is the most important Comstock certificate we have had. The Grosh brothers were two young men that first discovered silver on the Comstock around 1853. By 1856 they had assays of their rock over 2000 ounces per ton silver and wrote home to their father to tell him of the discovery, but asked for silence because of the unsure nature of their discoveries. Tragically, one brother died after striking his foot with a pick. The second brother died while taking samples to California for assay. In an incredible trip through the Sierra during a torrential winter storm, he and a companion, Richard Bucke, barely made it to Last Chance on hands and knees. Grosh, heavily frostbitten, lost his life. Bucke had his foot amputated at the ankle, and went to medical school, vowing never to return to mining, but to learn to help people in medical need. This he did for the remainder of his life in Toronto. The samples and maps that the pair took with them disappeared. A. Grosh, their father, meanwhile was home as a minister and writer in Pennsylvania. His writings to Bucke are well preserved, though generally not known to most historians when we rediscovered them about ten years ago. The senior Grosh hired Hastings at Hasting's request to press for his family's share in the Comstock, basing their claim on senior location of mining claims. Meanwhile, H. T. P. Comstock had taken the other maps and papers from the Grosh stone cabin near Gold Hill and sold them to Comstock interests, according to Court documents filed later. Comstock, unable to understand the importance or content of the maps, could have used them to tremendous advantage in the first days of his ;discovery but had no technical training, and may not have been able to read. Hastings formed the Grosh Consolidated to bring suit against Comstock interests. He claimed in letters to Grosh to have accepted an offer of $10,000 in gold to go away, which Grosh accepted, but died without Hastings ever paying him a cent. As best history can tell, Hastings kept the money. Hopefully time and budget will allow me to complete the editing and publication of the Grosh letters, which include the original surviving letters between the brothers and their father and the letters between the father and Bucke. Est. $3000-$6000

722. Nevada. Storey. Virginia. H. T. P. Comstock Original Documents, c.1865-68. Original documents involving H. T. P. Comstock in the Sierra Nevada Company, the Burning Moscow, etc, dated about 1865, 1868. These rare and unique documents are from title work done in the mid-1860's and surfaced in Placerville a number of years ago. There are two separate documents. First is a four page discussion by a judge, probably his decision notes and directions, involving a boundary dispute. ;It is important that the exact boundaries of the mine be ascertained in order that the fraction of the S. N. Co. are taking no more ore from gm (?) ground .the documentary evidence before me , the claim is uniformly described (description of claim). The claim is sometimes called the Caldwell & Co. claim, sometimes the Comstock & Caldwell. In one of the documents before me, after describing the ground, these words are used ;but not in any manner to interfere with the Walsh & Co mining ground – this instrument is dated 12th August 1859, at which time the Ophir ground was called the Walsh Ground, Judge Walsh and friends having acquired a controlling interesting the Ophir ground. So it would seem that the ground in question was bounded on the north by the McBoc (sp) ground and on the south by the Ophir ground. In the absence of a recorded location, proof should be established of the actual possession by the locators, and work done on the ground to the extent required by the mining laws of Virginia. Can this and the correct locality of the ground be established.

There is no proof before me of the recorded location of this ground by Caldwell & Comstock or by any other person – When did Caldwell part with his interest & to whom did he sell, then did Comstock derive his title – Where & when did H P Smith part with his interest

The next three pages lay out the facts as the Judge saw them. The three pages are a remarkable summary detailing the title problems of the original Comstock locations. Most of this data has been lost and these documents show the intense legal interest is solving the problems by the Judge. These documents may be some of the only documents remaining that discuss in detail the actual problems of title.

The second document is an incredible letter from an unknown person probably to the Judge describing when the title of the Comstock & Collins claim (August 8, 1859) [which, by the way, probably lets us speculate further that the original early location dates of March and April by Comstock are phony a conclusion already arrived at by many scholars, including myself]

;Comstock & Collins located this claim on the 8th day of August, 1859 & was in possession of it until 1861. They leased the ground to a man by the name of Gotshalk to run a tunnel in the quartz ledge and they was to give Gotshalk an interest in the mine. Gotshalk sublet it to a man by the name of Baker. I bought Comstock out & then bought Gotshalk out & then bought Baker out. That made my title good. I worked the mine about one year and could not make it pay & stopped work & stopped work on the mine & put a door on the mine & put the

tools in the tunnel & locked them in & left the mine in the care of a man by the name of Baxter. About one year after Baxter moved to Summit City. I have not been there since 1868. (pencil map showing Spanish Ravine, Burning Moscow lead, and the Summit Mill. This may have been one of the many cases that William Morris Stewart tried regarding Comstock locations cited by Lord in Comstock Mining & Miners, 1883. It certainly relates to the Burning Moscow vs. Ophir case that lasted for years. The notes may be those of the last judge, Judge E. D. Sawyer. More research is warranted. Est. $1000-2000

The billheads advertise ;fine watches, jewelry, diamonds and silverware.

The M. M. Fredrick business was truly one of the pioneer jewelry businesses in Nevada. It began as Eaves & Nye in Virginia City in late 1862 or early 1863. William T. Eaves and Emanuel Nye started their jewelry store on the corner of C and Union Streets. Eaves lived in the building, perhaps in an apartment in the back or upstairs as was the common practice in Virginia City at the time. Nye, a carpenter in 1862 in Virginia City, lived on Stewart. Eaves was not present in 1862 for inclusion in Kelley's First Directory of Nevada Territory. [1862 and 1863 Nevada Territory Directories]

Nye took over the partnership in the mid-1860's. By 1867 the firm was known as Nye & Rothenbucher, according to Langley's Pacific Coast Business Directory for 1867. Emanuel Nye may have briefly left Virginia City in the early 1870's. The name does not appear again until much later, and then as a saloon proprietor. In 1871, the firm Nye & Co. was run by Issac Fredrick, probably a relative of M. M. Fredrick. Both the Nye & Co. and Fredrick businesses were listed at the same address, 36 South C Street in the 1871 Langley Pacific Coast Business Directory. They were listed as watch makers and jewelers.

M. M. Fredrick took over the business and began using his own name in 1872, calling himself a ;manufacturing jeweler. The business made it through the fire of 1875. By 1877 Fredrick was billed as the ;Nevada Jewelry Manufactory, as listed on his billheads and in the Bishop's Directory of Virginia City and surrounds in 1878. Meanwhile, Fredrick's business was doing so well that he opened two other businesses. The M. M. Fredrick House, a lodging establishment on the north east corner of Union and C Streets, was opened about 1876 and run by his son, M. M. Fredrick, Jr. He also ran an auction business in 1876. [1876 Langley Pacific Coast Business Directory]

By 1883 Fredrick was known as the ;Pioneer Watch Maker, still located at the old shop address, 36 South C. His store and business was then twenty years old. [McKenney's Oregon State Directory for 1883 (and business directory of some western states).

748. Nevada. Storey. Virginia. Santa Rita Mining Co Dissolution Document Archive, 1864. Lot of 11 different documents all dated prior to Nevada Statehood. One document is a manuscript announcement of a stockholders’ meeting, Feb 24, 1864, to discuss a capitalization increase. The second document is a manuscript letter to stockholders covering the subjects covered at the Feb 24th meeting, including the potential dissolution of the company and take over by the Nevada Co. Also discussed in this document is a potential contract with the Honduras Co to construct a more gentle grade road for ore haulage. The third document is an amendment to the By Laws allowing for an increase or decrease in capital stock as majority vote rules, dated Jan 2, 1864. The fourth document is dated Feb 26, 1864, is list of all the stockholders and the amount of shares owned. This list alone is fabulous. The other 7 documents are proxies from stockholders allowing W. Van Bokkelen power of attorney to vote for them at the Feb 24 meeting. Each of these proxies have revenue stamps affixed. The Santa Rita MC was run by J. L. Van Bokkelen and Wm A. Van Bokkelen, who were living in Virginia City near the Latrobe Tunnel in 1863 Directory of Kelley. The company formed in the early 1860's, perhaps as a reorganization of the Latrobe Tunnel & MC, which was run by the Van Bokkelen brothers. During the early part of the 1860's, the Santa Rita tunnel supplied Virginia City with its water until the Cole Tunnel cut off this water source, allowing for the Cole Co to be the water supplier. J. L. Van Bokkelen was the president of the 1st Nevada Territorial Legislature and served on the 2nd Nevada Territorial Legislature. Wm. Van Bokkelen was a notary public. Sam Clemens visited the Latrobe Tunnel, sending a small package of rocks to Moffat. In a letter to Moffat, Clemens identifies the Van Bokkelens as San Francisco capitalists. The Latrobe tunnel was 1600 feet long and had two air shafts. At the end of the Ophir incline, Clemens (Mark Twain) picked up the rocks he sent to Moffat. At 11:00 on June 23, 1873, Major General Van Bokkelen was killed when the 100 pounds of Hercules Powder, 6 cases of Nitro, 100 pounds of Giant Powder and 200 pounds of common powder, that was stored under his bedroom, exploded.
